When it comes to securing a loan, immigration status plays a significant role. For many loan programs, such as the Dream for All initiative, lenders must confirm that a borrower is legally present in the United States. However, the rules and regulations surrounding what is considered "acceptable" immigration status can be vague or inconsistently applied.
In the case of our recent client, their status on a temporary visa raised questions from the lending institution, even though California law (AB-1840) states that lenders cannot refuse a loan solely based on immigration status. But federal lending guidelines still allow lenders to set their own risk tolerance, which created additional hurdles in our client’s situation.

While other lenders might have turned the client away due to uncertainty or confusion about the visa rules, we took a different approach. We believe that every borrower deserves a chance to achieve their homeownership dreams, and we are committed to doing everything we can to make that happen.
Here’s how we went above and beyond:
1. Thorough Research and Investigation: We didn’t take “no” for an answer. When our client was initially told their visa might not qualify, we dug deeper. We contacted Fannie Mae directly to clarify their vague guidelines, spoke with our internal experts, and reviewed state laws that apply to such cases. This allowed us to confidently move forward with the loan, knowing we had done everything possible to ensure compliance while advocating for the client.
2. Working with Lenders to Get Clear Answers: We reached out to the institutions involved in servicing the loan, including CalHFA and Lakeview, to make sure that our client’s loan would not be rejected after approval. By confirming every detail, we avoided the risk of funding a loan that might later be denied for purchase by a secondary institution.
3. Personalized Solutions for Long-Term Success: Our client wasn’t just another number to us. We took the time to fully understand their current and future immigration plans, including their transition from a temporary visa to an H-1B and eventually a green card through their partner. This level of personalized care allowed us to confidently proceed, knowing their long-term plans aligned with the terms of the loan.
4. Setting Precedents for Future Cases: This case was not only important for our client but also for others who may face similar challenges in the future. By going through this process, we were able to establish internal precedents that will allow us to expedite similar cases more efficiently in the future. What took a week of back-and-forth in this case can now be resolved in a matter of days.
At the heart of what we do is a commitment to making homeownership possible for everyone, regardless of their background or circumstances. This client’s experience illustrates how complicated the process can be, especially when immigration status is involved, but it also shows our dedication to finding solutions.
We understand that every client has a unique story, and we’re here to support them in every step of the journey. Whether it’s navigating complex visa rules, securing down payment assistance, or finding the right mortgage product, we go the extra mile to ensure our clients reach their goals.
